Mediation

Mediation

Mediation is a completely voluntary form of alternative dispute resolution. It involves an independent, impartial person helping two or more individuals or groups reach a solution that's acceptable to everyone. Sides can meet together or individually with the mediator.

What is alternative dispute resolution?

Mediation, is a form of alternative dispute resolution (ADR), a way of resolving disputes between two or more parties with concrete effects. Typically, a third party assists the parties to negotiate a settlement.

The Court Rules place a heavy emphasis on Alternative Dispute Resolution. Parties must use their best endeavours to resolve matters without the need of Court hearings. Failure to accept reasonable offers, or refusal to take part in Alternative Dispute Resolution methods, could lead to penalties in a final hearing. There are very few circumstances in which mediation will not be considered suitable.

We have been engaged in mediations of all kinds of different disputes.

Mediation costs are normally shared between the parties but are considerably lower than the costs of running a Court case. They have the added benefit of allowing for outcomes that would not be awarded through a judicial process.
