Do you receive rental income on a jointly owned property?  

If so, it is worth considering the income tax implications of this if you have not done so already.

We routinely prepare Declarations of Trust for joint owners of property who are in receipt of a rental income, but who split this income in different proportions between themselves. 

We occasionally need to advise clients in relation to their joint accounts. Usually, we find there are two scenarios:

  1. One party has removed funds from the joint account without the other person’s knowledge or consent or they have drained the account entirely and run up a debt.
  2. One party wants advice on how much they should remove from the joint account

Marriages break down for all sorts of reasons. Sometimes, this is due to infidelity. If you are in this position, you need to consider how cohabiting can impact your financial settlement on divorce.
